The terms for using CurlCue.

The agreement

These terms are an agreement between you and Jeovany Gutierrez(“CurlCue”, “we”). They cover the CurlCue app for iOS, CurlCue Pro, and this website. By creating an account or using the app you accept them. The privacy policy explains what we do with your data and is part of this agreement. Apple’s App Store terms also apply to the download and to any purchase.

Who can use CurlCue

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms on your behalf. You must be able to enter a binding agreement where you live, and you must not be someone we have previously removed.

Your account

• —Give us a real email address; it is how a forgotten password gets reset.
• —Keep your password to yourself. What happens under your account is yours.
• —One account per person. Do not make accounts for other people.
• —Your username must not impersonate anyone or be something we would have to remove under the acceptable-use section below.
• —We may suspend an account to protect the service or other users, and we will say why unless the law stops us.

What a score is, and is not

A CurlCue score is an informational, personalised opinionproduced by an algorithm. It reads a product’s ingredient list, judges each ingredient by what it is doing in that product for your hair profile, and applies a health gate before a look alignment. Two people with different profiles get different scores for the same bottle. That is the point.

It is not:

• —A safety guarantee. A high score does not mean a product is safe for you. The health gate is about buildup, stripping, irritation and hydration for a hair profile, not about your allergies or a medical condition. Patch-test anything new, and read the label yourself.
• —Medical advice. CurlCue does not diagnose or treat anything. If you have a scalp condition, hair loss, or a reaction to a product, see a professional.
• —A claim about the product’s quality or the brand.A low score means “a poor fit for this profile”, not “a bad product”.
• —Fixed. Scores change when the engine improves, when the catalogue is corrected, and when your profile changes.

The catalogue is built in part by the people who use the app. An ingredient list may have been read off a photo by a machine, or typed by another user, and may be incomplete or wrong. Manufacturers reformulate products without telling anyone. If the list in the app does not match the bottle in your hand, the bottle is right.

CurlCue AI

CurlCue AI is a language model. It is handed a score and the reasons behind it and asked to explain them; it cannot change a score and it is told never to invent one. Even so, it can be wrong, it can misread a photo, and it does not know anything about you that is not in your profile or your message. Treat what it says as an explanation to think about, not an instruction to follow, and never as medical advice. Do not send it anything you would not want a third-party AI service to receive; see the privacy policy for what is sent where.

Use of CurlCue AI is metered. The daily allowance is larger on Pro and may change.

CurlCue Pro

Scanning, scores and the routine builder are free. CurlCue Pro is an optional subscription that removes the ceilings: unlimited ingredient-label reads, side-by-side product comparison, AI routine rebuilds, and a larger daily CurlCue AI allowance. Exactly what Pro includes is shown on the paywall in the app and may change over time; if we remove something material from Pro during a period you have paid for, you can ask for a refund through Apple.

Billing

• —Pro is offered as a monthly or an annual plan. The price is shown in the app in your local currency before you buy. It comes from the App Store; the app never invents one.
• —Payment is taken by Apple through your Apple ID. CurlCue never sees your payment details.
• —The subscription renews automatically at the end of each period, at the price shown at the time of renewal, unless you cancel at least 24 hours before the period ends.
• —Cancel any time in your iPhone settings: Settings, then your name, then Subscriptions. Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for. Deleting the app does not cancel a subscription.
• —Refunds are handled by Apple, under Apple’s refund policy. We cannot issue one ourselves.
• —If you reinstall or change phones, Restore purchases on the paywall reconnects a subscription bought with the same Apple ID.
• —A Pro subscription is tied to your CurlCue account. If you delete the account, the subscription does not end by itself; cancel it in Settings first.

Prices may change. If the price of your plan goes up, Apple will tell you in advance and, where required, ask you to agree before the new price applies.

Free allowances

A free account can read a set number of ingredient labels with the camera each week (five at the time of writing, resetting at the start of your local week), and earns more, permanent, credits each time a product it submitted is approved into the catalogue. Barcode scans and scores are not counted. CurlCue AI has a daily allowance on every account.

These numbers, and what sits on either side of the Pro line, may change. The app always shows the current allowance; we will not reduce an allowance in a way that is not visible in the app.

Your content

What you post, upload or submit stays yours: profile photos, posts, comments, routines, tips, product photos, and the rest. So that the app can work, you give CurlCue a worldwide, non-exclusive, royalty-free licence to store, display, reproduce and adapt (for example, resize or crop) that content for the purpose of running and improving CurlCue, for as long as it stays in the app. Content you share with other users is shown to the audience your visibility settings allow.

You confirm that:

• —you have the right to share it, and it does not infringe anyone else’s;
• —any photo of a person is of you, or of someone who agreed to be shown in CurlCue;
• —it follows the acceptable-use rules below.

Deleting content removes it from the app. Deleting your account removes all of it, with the exceptions in the next-but-one section.

Blocking, reporting and removal

You can blockany user; blocking is symmetric, so neither of you sees the other’s posts or comments. You can report a post, a comment or a profile with a reason and an optional note, and reports are reviewed by CurlCue. If someone replies to your post, you can delete that reply yourself.

We may remove content, restrict features, or suspend or terminate an account that breaks these terms, that is used to abuse other users or the service, or that the law requires us to act on. Where we can, we will tell you what was removed and why.

Contributing to the catalogue

When you submit a product, photograph its label, read its ingredients, or record a price or a buy link, you are contributing to a shared cataloguethat every CurlCue user scores against. Once accepted, a contribution becomes part of that catalogue: it is shown to everyone, a stronger read of the same label may later replace it, and it stays in the catalogue after you delete your account, because other people’s scores are built on it. The record that you were the one who contributed it is deleted with your account.

For contributions you therefore grant CurlCue a perpetual, irrevocable, worldwide, royalty-free licence to use, adapt and distribute them as part of the catalogue. Contribute only what you have actually seen on the product, and only photos you took or have the right to submit. A front photo that is accepted becomes that product’s picture for every user, which is why the app refuses one that shows a face or a personal document.

Approved submissions earn scan credits. We may change or end that reward, and we may decline or later remove any contribution.

Acceptable use

Do not use CurlCue to:

• —harass, threaten, demean or impersonate anyone;
• —post hateful content, sexual content, or content that shows or encourages self-harm;
• —post spam, advertising you were not asked for, or links you are paid to post without saying so;
• —post anything you do not have the right to post;
• —submit products, ingredients, prices or links you know to be false, or that exist to promote a product or a store;
• —pass off CurlCue AI output, or a score, as medical advice to someone else;
• —scrape, copy or bulk-download the catalogue, the community or any other part of the service;
• —work around allowances, gates or limits, share an account, or automate requests;
• —probe, overload or interfere with the service or with anyone else’s use of it;
• —break the law.

Buy links and commissions

Some links to buy a product in CurlCue may be affiliate links. If you buy through one, CurlCue may earn a commission from the retailer. This does not change the price you pay, and it never changes a product’s score: scores are computed from ingredients and your profile, and the scoring engine has no idea whether a link earns anything.

Buy links are contributed by users and checked by us, but the retailer is not CurlCue. Prices, stock, delivery and returns are the retailer’s, and so is the page you land on. We remove any affiliate tags a contributor adds to a link they submit.

Where a retailer’s programme requires specific wording, such as the Amazon Associates statement, it is shown next to the link in the app.

CurlCue's rights

The app, the scoring engine, the catalogue as a compilation, the illustrations, the name and the mark belong to Jeovany Gutierrezor its licensors. We give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, under these terms and Apple’s usage rules. You may not copy, modify, reverse-engineer, resell or build on it except where the law says we cannot stop you.

If you send us feedback or suggestions, we may use them without owing you anything.

Ending things

You can leave at any time by deleting your account in the app (Profile tab, Privacy section, Delete account). We can end or suspend your access if you break these terms, if we are required to, or if we shut the service down, in which case we will give reasonable notice where we can. The sections that by their nature should survive (your licences to content you contributed to the catalogue, disclaimers, limitation of liability, governing law) survive.

Disclaimers

CurlCue is provided as is and as available. To the fullest extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not promise that a score is right for you, that the catalogue is complete or correct, that CurlCue AI is accurate, that the service will be uninterrupted or error-free, or that any product will do anything for your hair. Where the law does not allow a warranty to be excluded, it lasts for the shortest period the law allows.

Limitation of liability

To the fullest extent the law allows, Jeovany Gutierrez will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or the cost of substitute products, arising out of or connected to CurlCue, however caused. Our total liability for all claims relating to CurlCue is limited to the greater of the amount you paid us in the twelve months before the claim and fifty US dollars. Some places do not allow some of these limits, so some may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to cover us against claims by third parties that arise from content you posted or contributed, or from your breaking these terms.

Apple

These terms are between you and Jeovany Gutierrez, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to a warranty, you may tell Apple and Apple may refund the purchase price; beyond that, Apple has no warranty obligation for it. We, not Apple, are responsible for addressing any claim about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection claims, and for investigating and resolving any claim that the app infringes a third party’s intellectual property. You confirm that you are not in a country under a US embargo or listed as a prohibited party. You must comply with any third-party terms that apply when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law and disputes

These terms are governed by the laws of California, USA, without regard to its conflict-of-law rules, and any dispute will be brought in the courts there, unless the consumer-protection law where you live gives you the right to something else. If something goes wrong, email us first; most things can be sorted out that way.

If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer this agreement; we may transfer it to a successor that takes on the service.

Changes to these terms

We will post changes here and update the date at the top. If a change is significant, we will say so in the app before it takes effect. Using CurlCue after a change takes effect means you accept it; if you do not, delete your account.
